By using BYO Services on our platform, you agree to comply with this policy.

Ownership and Responsibilities

You affirm that you are the legal owner or have obtained lawful rights to use the domain and email addresses registered under your account with B2B Rocket. You must maintain control over the domains and email accounts and ensure that they comply with all applicable laws and regulations. You are solely responsible for the payment of all fees associated with maintaining your domain name and email services. It is your responsibility to ensure these services are renewed and remain active to avoid any disruption to the services provided by B2B Rocket.

Technical Setup and Maintenance

You are responsible for the proper technical setup of your domains and emails, including DNS settings, MX records, and any other technical requirements necessary for optimal operation. Failure to properly configure these settings may result in non-delivery, delay, or other service interruptions.

Email Warm-up and Health

You must take proactive steps to warm up your email addresses by gradually increasing the volume of emails sent. This practice is essential to establish a reputation with email providers and to avoid being marked as spam. You are also responsible for ongoing monitoring and maintenance of the health of your email accounts to ensure high deliverability and compliance with our platform's standards.

Email Deliverability

B2B Rocket is not responsible for your emails landing in spam folders or being blocked by email service providers. The deliverability of your emails is influenced by various factors including, but not limited to, your domain’s reputation, email content, recipient engagement, and compliance with email service provider policies.

To improve the deliverability of your emails and reduce the risk of them landing in spam folders, you should adhere to best practices in email marketing. This includes maintaining a clean mailing list by regularly removing unengaged leads, avoiding the use of spam trigger words in your email content, and using personalized and relevant content to engage recipients. Additionally, regularly testing email templates against spam filters and adjusting email strategies based on analytics and recipient behavior can significantly improve email effectiveness.

Compliance with Anti-Spam Laws

You must ensure all emails sent from your domains comply with international spam laws and regulations, which require explicit consent from recipients before sending marketing emails. It’s important to provide recipients with a clear and easy way to opt out of receiving future communications. Each email must include your physical mailing address and a straightforward way to unsubscribe from your mailing list. Failure to adhere to these regulations can result in severe penalties and damage to your and B2B Rocket's reputation.

Data Security and Privacy

You are responsible for ensuring that the use of BYO Services complies with all applicable data protection laws, including the secure transmission, storage, and handling of confidential and personal data through your domains and email accounts. To uphold the security and privacy of data transmitted through your domain and email services, you must implement robust security measures. These measures should include encryption, secure password policies, and regular security audits to protect against unauthorized access, disclosure, alteration, and destruction. Additionally, it is crucial to establish and maintain a data privacy policy that aligns with global data protection regulations (e.g., GDPR, HIPAA) to manage how personal data is collected, handled, and stored. In the event of a data breach, you are required to notify B2B Rocket within 24 hours of discovering the breach and provide detailed information on the extent and nature of the breached data, ensuring timely and appropriate measures to mitigate any adverse effects.

Intellectual Property Rights

In your use of BYO Services, you must ensure that all content, including text, images, logos, and other media, does not violate or infringe upon the intellectual property rights of any third party. Before using any third-party content, it's essential to obtain the necessary licenses or permissions. This not only applies to email content but also to any scripts, images, or software used on your domain. Documenting the source and license for each third-party element can help avoid legal issues related to copyright infringement.

Indemnification

You agree to indemnify, defend, and hold harmless B2B Rocket and its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your use of BYO Services or violation of this policy.

Limitation of Liability

B2B Rocket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from your use of BYO Services.

Dispute Resolution

Any disputes arising from or relating to the subject matter are to be handled as per the dispute terms dictated in B2B Rocket's Terms of Service Agreement.

We may revise this policy periodically to reflect changes in our practices, the law, or the evolving needs of both B2B Rocket and its clients. Termination
